THE DECISION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON PROVISIONS AND PROCEDURES FOR EXPORTING RATTAN.

Article 1

Provisions and technical procedures for exporting rattan regulated in this decision shall be regarding the export of non processed rattan, polished rattan and semi-finished rattan in the form of rattan core and rattan bark originating w cultivating rattan, including park/sega and irit rattan subsumed into Tariff Heading/HS Ex.1401.20.00.00 as meant in the provision in Article 1 paragraph (3) of Decree of the Minister of Industry arid Trade No. 355/MPP/Kep/5/2004.

Article 2

(1) The quantity and kinds of rattan which can be exported as meant in Article 2 of Decree of the Minister of Industry and Trade No. 355/MPP/Kep/5/2004 shall be stipulated every year on the basis of data on the availability of quantity and kinds if arrant obtained from regental/ municipal governments in this case Service in charge of forestry affairs for non processed rattan and Service in charge of industrial and trading affairs for polished and semi-finished rattan.

(2) The quantity and kinds of rattan already stipulated as meant in paragraph (1) only can be exported by Registered Exporter of Rattan (ETR).

Article 3

(1) The export of rattan by CTR shall secure export approval first from the Director General of Foreign Trade in this case the Director of Export of Agricultural Products and Minerals.

(2) In order to obtain the export approval, ETR shall submit application to the Director of Export of Agricultural Products and Minerals.

(3) To the application of ETR as meant in paragraph (2), the Director of Export of Agricultural Products and Minerals shall issue export approval with regard to the quantity and kind of rattan, loading port, destination country and validity period of the export approval.

(4) The quantity and kinds of rattan which can be exported by every ETR as meant in paragraph (3) shall be stipulated proportionally after considering:

Article 4

(1) The surveyor already appointed on the basis of Decree of the Minister of Industry and Trade No. 359/MPP/Kep/5/2004 shall apply verification or technical inquiry to the export of rattan by ETR already securing export approval.

(2) In order to enable the verification or technical inquiry into the export of rattan, ETR shall submit application net later than 3 (three) days before the date of inspection of goods to the surveyor by using the form of request for inspecting exported rattan (PPBE) from the said surveyor by enclosing packing list (P/L), invoice, approval of export of rattan from the Director General of Foreign Trade in this case the Director of Export of Agricultural Products and Minerals.

(3) The verification or technical inquiry into the export of rattan shall be done by procedures for inspecting rattan export as follows:

(1) Results of verification or technical inquiry into the export of rattan by the surveyor shall be contained in the form of:

(2) LS or LHP shall be issued by the surveyor not later than two times twenty-four hours after the inspection or supervision over the loading into container.

(3) LS as meant in paragraph (1) letter a shall be accompanied as export document in Export Declaration (PEB) to be given loading approval by the Customs and Excise Service Office at the loading port.

Article 6

(1) The surveyor shall collect cost from ETR with regard to the implementation of, verification or technical inquiry into the export of rattan whose results are contained in LS or LHP as meant in Article 5 paragraph (1).

(2) The amount of operational cost of the verification or technical inquiry into the export of rattan shall be stipulated in accordance with the principle of benefit on the basis of an agreement between the surveyor and ETR.

Article 7

(1) The surveyor shall convey report on the implementation of verification or technical inquiry in the export of rattan periodically every month to the Director General of Foreign Trade in this case the Director of Export of Agricultural Products and Minerals.

(2) Violation of the obligation to convey the report as meant in paragraph (1) can result in revocation of appointment of surveyor as the executor of verification or technical inquiry into the export of rattan.

Article 8

Other provisions and technical procedures related to the implementation of verification or technical inquiry into the export of rattan shall be made by the surveyor m accordance with the standards in force.

Article 9

(1) The Director General of Foreign Trade can establish a working team to monitor and evaluate the implementation of policy on the export of rattan as meant in Decree of the Minister of Industry and Trade No. 355/MPP/Kep/5/2004.

(2) The membership composition of the working team as meant in paragraph (1) shall consist of representatives institutions/units/agencies concerned in the field of the export of rattan.

Article 10

The decision shall come into force as from the date of stipulation.
